In addition to being a Bonded and Registered Legal Document Assistant, I also have a Juris Doctorate degree and have taught both Legal Research at CSUB as well as upper division law school classes at Lady Justice Law School. I have experience in assisting attorneys in performing legal research and drafting pleadings for filing with the court. I have experience in Family Law, General Civil Litigation and Debt Collection.
I am available to meet with clients to gather facts and prepare supporting declarations.
Family Law
There are many different types of Family Law filings, from the initial Divorce/Dissolution to Post-Judgment matters such as Qualified Domestic Relations Orders. The following are some of the more common filings and the flat fee for each.
All pricing is for us to prepare, file, and serve (via mail) all documents for an uncontested matter. If the case becomes contested you can either represent yourself in court or hire an attorney. If the judge requires a hearing for your case to be settled there are additional fees to prepare and file paperwork. If personal service or additional process serving is necessary or process serving outside of our local area, there will be an additional fee. You are free to handle the service of process yourself if you wish or we can refer you to local Process Servers that are available to assist you.
The Mandatory Superior Court fees are not included in the prices below. The Superior Court will charge upon filing, unless you qualify for a fee waiver. Check to see if you qualify for a fee waiver: https://www.courts.ca.gov/documents/fw001.pdf
Small Claims
Many different types of cases can be filed in Small Claims Court and there are also deadlines within which to file your claim.
Demand Letter - $125
A person who sues in Small Claims must first make a Demand upon the Defendant. The Demand Letter will give the Defendant up to 30 days to resolve the Amount owed. We prepare and Serve the Demand Letter to the Defendant for a flat fee. If they do not pay in full, you may proceed in filing your Small Claims suit.
Small Claims Filing - $275
Flat fee includes: Preparing and filing necessary Court documents.
PLUS Mandatory Court Filing Fees as follows:
Filing claim for $1,500 or less -- Filing Fee $30 Filing claim for more than $1,500 but less than or equal to $5,000 -- Filing Fee $50 Filing claim for more than $5,000 but less than or equal to $10,000 (by natural persons only, with certain exceptions) - $75 Filing claim by person who has filed more than 12 small claims in California within the previous 12 months - $100
Unless you qualify for a fee waiver.
Process Serving - there may be additional fees for service of process.
GENERAL SMALL CLAIMS COURT INFORMATION
How much can you sue for in Small Claims Court?
Individual persons can sue for a maximum of $10,000
Businesses Max $5,000
An individual cannot ask for more than $10,000 in a Small Claims Action. Businesses and other entities cannot ask for more than $5,000. This limit on businesses does not apply to sole proprietors, who are treated as individuals. A person/business may only file two claims per year seeking more than $2,500. However, you may file an unlimited number of claims per year for no more than $2,500.
Types Of Small Claims Cases
There are a variety of cases that may be filed in Small Claims Court.
Some of the more common types of cases filed are disputes regarding:
Landlord/Tenant security deposits;
Property damage or personal injury from an auto accident;
Collection of money owed;
Damage to your property by a neighbor;
Suits against an auto repair facility for work done on your vehicle;
Homeowner association disputes;
Disputes with contractors regarding repairs or home improvements' and
Many other issues.
Preparing for Small Claims court
Witnesses - it is ALWAYS better to bring live witnesses testify in Court. The Judge may allow a written declaration to be submitted under limited circumstances. If allowed, must be signed under penalty of perjury and include address and phone number for witness.
Be sure to bring 3 copies of all evidence you would like to present to the Judge (one for the Judge, one for you and one for the opposing party).
It is helpful to bring copies of any agreements, photos, bills, receipts and other relevant documents that support your claim.
